Red light tickets are $190
Did you get one, or do you know this because you are an officer of the court? 
I got one and was surprised by how expensive it is.

We're also assuming this is for running a red on a bicycle and not a motor vehicle and the cost was the same?
The fine is the same ($190), the surcharge ($88) is imposed only for motor vehicles.  So it would be $190+$88 for a car.  That's if no other red light tickets in a certain period of time.  2nd in 18 months = $375, 3rd in 3 months = $940.

Their guidance was to call 911 and have a squad car with me; I'm not putting some guy whose life is already a giant shit sandwich further into the gutter for 200 bucks.

That and it's been six months; how do I know he stole it? He claimed to have been paid in barter with it.

Of course when I left I told him to keep his head down for the next 4 years - that's when he told me that Trump "was the only one who told the truth..."

My guess is he's not the thief. Anyone who steals something like that is not going to want to store it for 6 months to net $200. Unless maybe he really needed it to get his kids to school....

i regularly represent people accused of possessing and selling stolen property and i think jules has the right of it.  unless you have an insurance interest and need to document the loss, not much point in calling the cops over it.

i have not yet seen someone arrested for a $200 theft via craigslist.  too much work for the detectives/cops and not enough payoff--it wouldn't even result in a felony arrest.  at $1,000 value the larceny becomes a felony (no value required if it's stolen from your person or the property stolen consists of a credit card...those thefts are felonies regardless of value).  from my side of things, it seems the police favor felony arrests and generally don't invest their time in misdemeanor arrests that require actual investigation (proving a chain of custody through craigslist via serial numbers in jules' case)

I'm with both of you on this. Those bikes are darn expensive for zero carbon so when it was completely gone we filed the police report.

Who steals a bike, strips a couple hundred bucks worth of parts from it then lists it for 200 bucks six months later? It's not like you just forget you've got that behemoth stored in your hovel.

Got hit by a truck today on my commuter. Heading to a work meeting in Long Island City, crossing Queens Blvd with the green light from one section of the bike path to the other, when a Budget truck rolled through a red and just caught my front wheel. I got thrown to the pavement. He stopped and offered to call an ambulance or whatever so we got ourselves out of the traffic lane and called 911. EMT came and checked me out and cops came and did a report that I can pick up tomorrow at any precinct (computers, yay!). I'm sore and a bit scraped up but for the most part OK.

A couple questions:

I didn't think to get his insurance info since the police were there doing a report. Was that a mistake? He said he worked for a moving company with insurance even though the truck was a generic Budget truck. Will that info be on the police report?

Assuming when I pick up the police report it has the info I need, is there any benefit to me trying to get something out of his insurance? I don't have any medical bills and the extent of the bike damage is that I need to build a new wheel around my still functional hub (and buy a new tire). That maybe $100 - $150 at most. I anticipate the headache involved trying to get them to pay for the wheel wouldn't be worth it. Any thoughts?


My good man...that was NOT a "commuter" and that hub is NOT functional.  In fact that bike may have structural damage that is irreparable.  May be time for a new bike...something in titanium, with carbon wheels, a power meter and E-tap

Ah, Jesus, Jim, I'm sorry.  That sounds pretty frightening.  I'm glad you're ok.  Something like that would have left me shaken for quite some time.

Let's talk practical, and let's talk ideal.

Practical:  You did everything right.  Police came and handled the situation, wrote a report, took information.  I know you were civil because you're one of the nicest people I know, you got the information you needed from the police, you were (should have been) shaken and banged up, no need to stress your head about anything other than getting better.

Ideal: Yes, get their information.  Take a picture of the license plate, your bike, the intersection where it happened, the driver, the cops, everything.  Take pictures.  Take a picture of your wheel right now. Get a picture of the number on the cop car.

Cops have shitty handwriting and don't keep details straight.  Their report will be incorrect, so talk with them about what they're writing, explain in detail what happened, over and over again.  Say it's a concussion, you don't remember you just told them - not joking here.  Make sure they write it out correctly.

(When you get the report, check for inaccuracies.) 

Get the guy's business card, his name, the name of the company.  Write it in a text and send it to yourself.  It can be embarrassing to have to ask for that information, but he hit you so fuck him.

Now call Lucarelli & Castaldi.  I've spoken with them before.  They're super nice and they'll answer your questions.  If there's insurance, there's something to pursue.  You don't need a new wheel, as mentioned, you need a new bike.  Seriously.  If they can get a 15k insurance settlement, they'll discuss what's involved.  They may not want to take on something that small, but tell them who you are and what team you're on.

This isn't light stuff we can brush off.  Nothing may come of it, but if something can, it should.  Drivers who don't pay attention have to be held accountable.  As do the companies who hire them.  L&C can advise you about whether there is anything to pursue.

Give L&C a call; I don't think the price of a wheel is worth any major headache(s) but you have no idea yet how you'll feel tomorrow or if you'll find anything else wrong with your bike when the smoke clears.

Jim - I'm glad you're ok. Queens Blvd is a nightmare for bikes and peds. Also, I think there's a fee to get your accident report.
if the police did their job correctly the DMV accident report (form MV 104, https://dmv.ny.gov/forms/mv104.pdf) form will have his insurance on it.  it will also have what the police think was the cause of the accident.   if it's wrong you can try to correct it.  

you will need to download a separate form key to look up what the police are claiming happened.  i've attached the MV-104-cov form, which you print up and hold up next to the MV-104 to decode it.  each box contains a number, use the cover sheet to look up the meaning of the number
